Welcome to GiftsInStories.com ("Service", "we", "our", or "us"). By accessing or using this website, you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the Service.

Definitions

• "Service" – the AI-powered system that generates and delivers personalized audio stories.
• "Content" – the stories, audio files, text, and materials provided through the Service.
• "Order" – a purchase request submitted by a User for the creation of personalized content.

2. Eligibility and Age Requirements

To use GiftsInStories, you must:

• Be at least 18 years old
• Have the legal capacity to enter into binding agreements
• Provide accurate and complete information when placing an order
• Comply with all applicable laws and regulations in your country

Parental Purchase:

Our stories are designed for children, but the service is intended only for adult users. By placing an order, you confirm that you are of legal age and are purchasing on behalf of a child or family member.

3. Our Service

GiftsInStories provides AI-generated, personalized audio stories for children. Each story is based on the details you provide during checkout (e.g., name, theme, or tone).

Each order includes:

• Audio Story File (digital MP3 or equivalent format)
• Personal Text Narrative (optional downloadable transcript)
• Instant Digital Delivery (via email or private link)
• Personal Use License (see Section 5)

All stories are created using AI technology and reviewed by human editors to ensure clarity, emotion, and narrative quality.

4. Order Process and Delivery

When you place an order:

1. Submit Details — Choose the story's age range, theme, and personalization.
2. Payment — Complete a secure payment through our trusted partners.
3. Story Creation — Our AI generates a unique story tailored to your selections.
4. Voice Generation — Licensed synthetic voices bring your story to life.
5. Digital Delivery — You receive your story by email within minutes.

Delivery Timeline:

• Standard delivery: typically within 15–60 minutes.
• Delays may occur during high demand or maintenance.
• You will receive a confirmation email once your story is ready.

5. Refund and Return Policy

Because each story is custom-made and digitally delivered, all sales are final once your story file has been delivered or downloaded.

Refunds may be granted only in the following exceptional cases:

• Technical Issue: The file is corrupted or unplayable.
• Delivery Failure: The story is not delivered within 48 hours.
• Content Error: The story contains significant factual or personalization errors.

To request a refund or report an issue, contact hello@giftsinstories.com within 48 hours of delivery. We respond within 3 business days.

6. License and Usage Rights

When you purchase a story from GiftsInStories, you receive a personal, non-commercial license to use it for private enjoyment.

All intellectual property in the stories, including the text and narration, remains owned by GiftsInStories
(PSD coding s.r.o.).

7. AI-Generated Content Disclaimer

All stories provided through GiftsInStories are created with the help of artificial intelligence (AI) and synthetic voices. While we strive for emotional realism, creativity, and family-friendly quality, please understand the following limitations:

• AI Training Data: Our AI models are trained on a mix of licensed data, publicly available text, and proprietary datasets.
• Original Creation: Each story is generated uniquely based on your inputs, though similar outputs may occasionally occur for different users.
• Creative Variations: AI may interpret your ideas differently, leading to variations in tone, pacing, or style.
• Accuracy and Context: While we aim for precision, AI may misunderstand or generalize certain topics.
• Cultural Sensitivity and Bias: Although we design our systems to be inclusive, AI models can sometimes reflect bias — meaning patterns or perspectives learned from training data that may not represent all cultures or viewpoints equally.
• Non-Human Narration: Voices are digitally generated and not performed by live actors.

We review stories for clarity and appropriateness before delivery.

8. User Responsibilities

When using GiftsInStories, you agree to:

• Provide truthful and accurate information when submitting story details.
• Use the service for lawful and appropriate purposes.
• Avoid including any offensive, explicit, or discriminatory content in story requests.
• Not attempt to interfere with or exploit the system or AI platform.

Any misuse of the service may result in suspension or denial of future access.

9. Privacy and Data Protection

Your privacy matters to us. We collect and process limited information necessary to deliver your personalized story, manage your order, and improve your experience.

All personal information is handled in accordance with our Privacy Policy. By using GiftsInStories, you consent to data processing as described in that Privacy Policy.

We never knowingly collect personal information directly from children.

9.1 Email Communications

By providing your email address, you agree that GiftsInStories may contact you for the following purposes:

• Transactional Emails: messages essential to fulfilling your order — such as order confirmations, delivery notifications, receipts, or support updates.
• Order Recovery Emails: if you start but do not complete a purchase, we may send limited follow-up reminders or offers to help you complete your order.
• Promotional Emails: optional updates, special offers, or new product information, which you can unsubscribe from at any time.

You can opt out of order recovery or promotional emails by following the unsubscribe link included in each message. Transactional messages (such as confirmations or delivery links) are necessary for service delivery and cannot be opted out of.

10. Limitation of Liability

To the maximum extent permitted by law, GiftsInStories shall not be liable for:

• Indirect or consequential damages (e.g., lost profits, emotional distress).
• AI system inaccuracies, voice errors, or quality variations.
• Temporary unavailability of the service.
• Third-party software or network issues.

Our total liability for any claim is limited to the amount you paid for your story, not exceeding $50 USD.

11. Service Availability and Modifications

We continuously work to improve and maintain the GiftsInStories Service. This may include updates to features, performance, or technical infrastructure. Temporary interruptions may occur during maintenance, upgrades, or due to external issues such as hosting or network outages.

We may also revise these Terms from time to time to reflect:

• legal or regulatory requirements,
• product or feature updates, or
• feedback from users or partners.

All updates will be published on our website with the "Last updated" date shown at the top. By continuing to use GiftsInStories after an update, you agree to the revised Terms.

If you do not agree to the new Terms, you must stop using the Service.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Slovak Republic, applied in accordance with international business standards. However, this service is offered only to users in non-EU countries (US, UK, CA, AU).

Any disputes shall be resolved in good faith. If informal resolution fails, jurisdiction lies with the courts of the Slovak Republic.

If you are a consumer residing in the European Union or the United Kingdom, you may also be entitled to bring legal proceedings in your country of residence under applicable consumer protection laws.

13. Entire Agreement

These Terms constitute the entire agreement between you and GiftsInStories regarding the use of the Service and supersede any prior agreements, communications, or understandings.

If any part of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full effect.
